Terms of Service

The rules for using infectus.io and the upcoming game Infectus, currently in development. Please read them carefully. Last updated: 23 September 2026.

1. Acceptance of These Terms

By accessing this website, entering our community channels, or accessing the game once it becomes available, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the website or the game. These Terms form a binding agreement between you and ODY Technologies e.U. ("we", "us", "our").

2. The Service

"The Service" means this website and the game Infectus, together with related community channels, updates, and content we provide. The website is currently a pre-launch teaser; the game is in active development. Features described here or on the site are plans, not promises, and may change or be discontinued.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service you confirm that you meet this age requirement and that you are legally able to enter into these Terms.

4. Pre-Release & Test Versions

Until its public release, the game is unfinished, pre-release software provided for testing and feedback. It may contain bugs, change substantially, be unavailable, or be discontinued at any time. Game worlds, territory, progress, and virtual items may be reset, wiped, or lost during development, and we do not guarantee that any test data will carry over to later versions or to launch. We make no promise that the game will ever be publicly released.

5. Accounts

When game accounts become available, you are responsible for keeping your login credentials secure and for all activity under your account. Accounts are personal to you, non-transferable, and limited to one per person unless we say otherwise. You must provide accurate information and keep it up to date. We may suspend or close accounts that violate these Terms.

6. Acceptable Use

You agree not to:

  • cheat, or use bots, automation, exploits, or third-party software that gives an unfair advantage or disrupts the game;
  • harass, threaten, defame, or abuse others, or post illegal, hateful, or infringing content;
  • use the map or other game information to identify, locate, stalk, or harass real people, or publish where other players live;
  • access accounts, systems, or data that are not yours, or attempt to breach security;
  • reverse-engineer, decompile, or extract source code, except where the law expressly allows it;
  • sell, buy, or trade accounts, virtual items, or currency outside mechanisms we officially provide;
  • disrupt, overload, or interfere with the Service or with other players' use of it.

7. Virtual Items & Currency

Any in-game currency, boosts, skins, cards, or other virtual goods are licensed to you for use within the game only. They have no real-world monetary value, are not your property, and cannot be exchanged for cash or transferred out of the game. We may modify, remove, or reset virtual goods at any time, particularly before the public release. If your account is closed or terminated, any unspent virtual goods are lost without compensation. Your statutory consumer rights remain unaffected.

8. Purchases, Prices & Right of Withdrawal

Virtual goods may be offered for purchase inside the game. Payments are processed by Stripe; we never receive or store your card details. Prices are shown in euro, including any applicable VAT; the amount displayed is the amount charged.

Delivery. Purchases are credited to your account as soon as the payment is confirmed, normally within seconds. Some payment methods settle more slowly; in that case the purchase appears once your bank or provider confirms the payment.

Right of withdrawal. As a consumer you normally have fourteen days to withdraw from a distance contract. Because virtual goods are digital content delivered immediately, you are asked at checkout to expressly request immediate delivery and to confirm that you thereby lose that right of withdrawal. The purchase cannot be completed without that confirmation, and we record it together with your order and repeat it in your purchase confirmation.

Refunds. Beyond the statutory rights above, purchases are non-refundable once delivered. If something goes wrong with a payment (you were charged and received nothing, or were charged twice), contact us and we will put it right.

9. Intellectual Property

The Service, including the game, its name, logos, characters, artwork, and code, is owned by ODY Technologies e.U. or its licensors and is protected by copyright and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, distribute, or create derivative works from our content without our written permission. Any content you submit (e.g. player names, community posts) remains yours, but you grant us a worldwide, royalty-free licence to host and display it as part of operating the Service.

10. Third-Party Services

The Service relies on third parties, including Cloudflare (hosting), map services based on OpenStreetMap (map data © OpenStreetMap contributors), and Stripe (payment processing). Your use of those services is also governed by their own terms and privacy policies, which we do not control.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. This applies especially to pre-release versions. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that data will be preserved. Nothing in these Terms excludes rights that cannot be excluded under mandatory Austrian or EU consumer law.

12. Limitation of Liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, progress, or virtual items arising from your use of the Service. Our liability for slight negligence is excluded, except for injury to life, body, or health, or for breach of essential contractual obligations. Mandatory liability under Austrian law (including the Product Liability Act) and your statutory consumer rights remain unaffected.

13. Term & Termination

You may stop using the Service at any time. We may suspend or terminate your access, including any account, if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and liability) will continue to apply.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, you also benefit from the mandatory protections of the law of your country of residence, and nothing here deprives you of those rights. Place of jurisdiction is, to the extent legally permissible, the competent court in Austria.

15. Changes to These Terms

As the game evolves (game client, accounts, payments), we may update these Terms. We will post the updated version here and announce material changes on the website and in the game before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
